New ELA Law in Spain: rights and improvements for patients and caregivers

Under the new regulations, ALS patients will have access to comprehensive care and automatic recognition of disability, as well as establishing benefits for caregivers.

Ibuprofen Official State Gazette (BOE) published the ELA Law This Thursday, it promises to improve the quality of life of people with Amyotrophic Lateral Sclerosis and other complex diseases. The law will come into force on November 1st. The Senate passed the bill on October 23, after it received unanimous support in Congress on October 10.

Legislative Process and Institutional Commitment

The urgent processing of the law demonstrates the commitment of public institutions to offer rapid and effective responses to the needs of these patients, who have been waiting for the law for years. The approval process was long and complicated, marked by numerous amendments from various parties and several delays, including those caused by early elections in the summer. The Law, which will come into force on November 1, has been approved after a process in which not only political groups have participated, but also associations such as the National Confederation of ALS Entities (CONELA). Specific Provisions and Protection of Caregivers

Among its provisions, the law establishes that All people with ALS will automatically receive a disability rating of 33% or higher. It also encourages coordination between health and social systems to ensure comprehensive care. It establishes an individualized care plan that includes home care and access to specialized multi-professional teams.

The law also aims to protect caregivers by granting them specific rights. It includes aid to maintain their Social Security contributions if they leave their job. Priority will also be given to their access to employment policies after completing their care work.

Finally, the ELA Law promotes the Training and specialization of health professionals in complex and irreversible diseases, such as ALS. This ensures more effective and humane treatment for those affected.

Implementation of the ELA law

Update of January 12th: The Ministry of Health has shared more information about the different phases of implementation of the ELA Law. It highlights how the first phase streamlines procedures for disability and dependency. It also describes measures to improve coordination between health and social services, as well as the training of medical professionals.
